Due Diligence.

Some people say we should take Chris Mintz at his word, that researching his past and putting it under public scrutiny is somehow traitorous to Democrats, that I should be ashamed of myself for creating my web site. They are welcome to that opinion but I have no respect for folks that fail to exercise political due diligence and simply take at face value what a candidate says.

Mr Mintz makes a big deal on his website and in his mailings about being a candidate of trust and integrity and how he earned that trust while working for a large investment firm. On his website he says:

"He began his career with a regional investment firm. There he learned the value of developing lasting relationships with clients and their families built on principles of trust, integrity, and understanding."


When I look at this mans past, there is nothing to trust, there is no integrity, there is no understanding and I might add there is no loyalty.

court documents say they trusted him enough to put him in a mentorship program, give him a portfolio to work with that was worth millions and six months later he terminated without notice, violated his employment agreement and secretly tried to divert 18 million dollar portfolio to Merrill Lynch. EJ successfully got a temporary restraining order against him. Mintz tried to get the restraining order lifted claiming hardship but the Judge in this case after reviewing the evidence against him, denied his claim, made him to put up a $15,000 bond and go into arbitration.
All the sordid details are in court documents I uncovered on the 11th floor of the county court house doing public document searches.

Shortly after Mintzs' defection from Edwards Jones and his court troubles he also defects from Merrill Lynch and moves to Oak Island working part of the time for Security Savings Banking where coincidentally there is a Roy Mintz Jr on the board. Three years later Chris quietly returns to Raleigh where according to the SBOE website he has only voted once in his entire life some dedication to politics

Back in Raleigh he rises to prominence in the Republican party as an officer/president of an auxiliary and 8 months later abruptly resigns his position and defects yet again.

Once he becomes a Democrat, Despite his claim to listening, understanding and building trust he refuses repeated requests to run as a Dem in his own home district, the NC Senate 15th, against Neal Hunt and instead decides to run against a long time, hard working dedicated Democratic party Member.


Does anyone see a pattern here? My mom told me once a long time ago when discussing bad habits, there is no two times without a third. Given his history do we really want to trust Mr Mintz and be the beneficiary of that
3rd shafting.

Any responsible voter will want to exercise political due diligence when evaluating which candidates we as Democrats should support in a primary and which we as voters should support on Election Day. Not every Democratic candidate is a real Democrat - and I want to make sure that we don't get "punked" or "Bunkey-ed" like Chatham County did by Repug turned Democrat Bunkey Morgan who pretty much handed over Chatham County to the development interests.

The process of researching, understanding and, in some cases, avoiding risks is known as due diligence. "Due diligence is going in and digging a hole in the ground and seeing if there's oil, instead of taking someone's word on it," says Joseph Bankoff, a partner in the intellectual property and technology practice at law firm King & Spalding in Atlanta. "If you don't do a sufficient amount of due diligence, you don't really know what questions to ask."

Due diligence entails taking all the "reasonable steps" to ensure that both buyer and seller get what they expect "and not a lot of other things that you did not count on or expect," Bankoff explains. The process involves everything from reading the fine print in corporate legal and financial documents such as equity vesting plans and patents to interviewing customers, corporate officers and key developers. It helps to identify potential risks and red flags. "It's the kiss of death to make an improper acquisition or investment. Not only are you buying a dog, but the dog can kill your company."


Due diligence (also known as due care) is the effort made by an ordinarily prudent or reasonable party to avoid harm to another party. Failure to make this effort is considered negligence. Quite often a contract
will specify that a party is required to provide due diligence. In lay terms, due diligence is the reponsibility you have to investigate and identify
issues, and due care is doing something about the findings from due diligence.

Since our Democratic party is not able to perform such due diligence on candidates who run under our banner, we activists must. I can't believe that anyone is complaining about a Democratic party activist like me performing political due diligence on Mr. Mintz given his fiduciary problems with prominent investment firms, background in the Republican party, recent "conversion", and support by big-time "developers".

I am sure that a financial services professional like Chris Mintz would counsel any
of his clients to perform due diligence on both his firm and investment vehicles offered by his firm.


Exercising my right to perform political due diligence is not only proper it is imperative and it would be grossly negligent to not do so.

In the interests of transparency and as a candidate running for public office, Mr Mintz needs to clear up the circumstances surrounding the Temporary Restraining Order Edward Jones successfully filed against him and make public the outcome of the arbitration settlement he was forced to accept when posting his $15,000 bond.

I offered Mr Mintz the opportunity to comment on these matters before publishing this Blog, I waited 5 days for a written response from him and still there is none. Here is the e-mail exchange:

Chris, Can you comment on your troubles with Edward Jones and Merrill Lynch, the restraining order, the denial of your motion to stay the restraining order, and the details of your arbitration settlement? I think this speaks to your website claim of trust, integrity and leadership. Would you make public the settlement in the interest of transparency? Regards, Max
