Kissell Goes Into Recount 339 Votes Down; Provisional Vote Phase Essentially Over

Today netroots hero Larry Kissell asked for a recount. When I left the Mecklenburg County Board of Elections at 10:00 pm EST, Larry was down 339 votes district wide, so that's the all-but-final pre-recount number.

Many people have asked how they can help. This is a link to the recount fund. Or help Larry pay off his $45,000 in campaign debt (that's more than a teacher in Biscoe makes in a year). If you can't contribute, I'm sure Larry would simply ask for your prayers. If that's not personal enough for you, you can send your support by calling 1-877- 4 KISSELL (1-877-454-7735).

What about the recount process itself? It will run Monday through Wednesday, after which there will undoubtedly be a hand recount (because, if Larry is up after the recount, Hayes will give no quarter, and Larry wants a hand recount because 9 of the 10 counties in the 8th use optical scan ballots). The hand recount starts in a randomly selected 3% of precincts; Larry would need to gain 2-3 votes average in each of these precincts to initiate a district-wide hand recount. I'll be happy to answer any other questions.

A: There are some provisional ballots that are still in limbo. Most of them would probably help Larry, but for the most part, the provisional phase is over. We haven't given up on getting some of the outstanding provisionals, however.

Larry Can still go to Congress?

Larry can still go to Congress reguardless of the fight for the legal votes. As close as the election was. The 110 th Congress can simply declared Larry the winner since Congress will be control by the Democrats.

You find that Congress has declared congressional winners in recent close elections.

Examples ..."B-1" Republican Bob Dorman races in Southern Califorian and Congressional Races in Indiana.

I would urge folks to put the heat on this approach reguardless of the heat from the Republicans or certain control Democrats in DC.

I think the law reads - a random 3% of precincts in each county rounded up to the next whole number. I imagine for most counties - save Cabarrus and Cumberland - that means one precinct per county. I initially thought it was 3% district-side. I would hope that counties like Hoke and Anson would not be left out of the initial recount (hand-eye) just because they have a small number of precincts.

They do count each early vote location as a precinct, but I think Meck was the only county with a large number of early vote locations. I don't know about Cabarrus and Cumberland Counties. Do you?

I know of one.

Cabarrus had only one early voting location, and that was at the Board of Elections office in downtown Concord.

Actually, what the lawyer told me was that

Some counties (like Anson, which has 11 pcts) will be folded into county clusters, while other counties will get the "3%" of their precincts.

I have a novel idea. Let's encourage our legislators/staff attorneys to say what they mean when they write laws.

Anson has 11, but then you add one for the early voting. I need to read the law again. I can't remember if each early voting location is considered a precinct or if it's all early voting equals one precinct. Only matters in Meck.

I read the law book while I was with him

Each EV location counts as a precinct. So things get weird in Meck, for example, if two people voted at an early voting location way outside the 8th district. Or if say 5 or 6 voted at BOE.

we simply have to hope that it isn't an early vote precinct selected in Mecklenburg County....but then with the touch screen machines it might not matter which precincts are selected.

I imagine the same is true for Cumberland, then. It is possible that Meck would have 2 precincts counted if that is the case. It would be nice if the law was a little more clear about some of these things.

Looks like you imagined correctly.

Based on a quick Google search and this website, it looks like Cumberland did the exact same thing Cabarrus did in regards to early voting.
